PARTICIPATING IN AIR POLLUTION CONTROL COMMISSION DURING COVID-19

In response to the COVID-19 outbreak in the State of Alaska, the Assembly adopted Emergency Ordinance No. 2020-12. This ordinance authorizes the Mayor to modify and/or waive provisions pertaining to scheduling, public participation, teleconference, and other related provisions of code related to public meetings.  Those modification are available here. 

Effective March 28, 2020, Governor Dunleavy issued Health Mandate 11, which states that all persons in Alaska, except those engaged in essential health care services, public government services and essential business activities are mandated to remain at their place of residence. Further, the Juanita Helms Administration Center (JHAC), including the assembly chambers, is closed to the public at this time.

To comply with Governor Dunleavy's mandates the following procedures are in place to allow citizens to continue listening to meetings, to participate in meetings by submitting written comments and to testify telephonically. Thank you for your diligence in complying with these mandates and for your patience as we navigate new procedures.

HOW TO LISTEN TO MEETINGS

HOW TO PROVIDE TESTIMONY

WRITTEN TESTIMONY

Members of the public wishing to provide comments on items not on the agenda may do so by e-mailing your comments to CommunityPlanning@fnsb.us.

For quasi-judicial matters, the Testimony by Affidavit procedures are unchanged. Under certain circumstances, a person may apply and the Chair may permit testimony by affidavit, subject to the opposing party's right of cross-examination. These applications have strict deadlines. A person who did not receive a "Dear Property Owner" notice letter but who wishes to provide testimony by affidavit may apply for a pre-hearing determination that the person is an "interested person" as defined in FNSBC 17.04.010.  The person shall e-mail the completed pre-hearing determination form to CommunityPlanning@fnsb.us by the deadlines established in Rule 45 and 47, which can be found on the website: http://www.fnsb.us/Boards/Documents/Rules%20of%20Order.pdf

TELEPHONIC TESTIMONY DURING MEETINGS

To sign-up for telephonic public testimony on items not on the agenda, complete the Sign-Up form for Telephonic Testimony below.  If you are an interested person, or a person who did not receive a "Dear Property Owner" notice letter but you wish to seek a determination that you are an "interested person" as defined in FNSBC 17.04.010, and you wish to testify on a quasi-judicial matter, please specify the case below.

To complete the form, enter your first and last name, email address, phone number for the Clerk to call you during the meeting, and subject. Subjects are public comments, or the quasi-judical case number, for hearing.  

WHAT TO EXPECT WHEN TESTIFYING

Public testimony and testimony on each case will be heard from citizens/interested persons in the order in which they have signed up. The Clerk will call those citizens/interested persons who have signed up to testify at the phone number provided when it is your turn to speak. Please note: If you do not answer the phone we will move to the next person on list.

Once you are placed into the meeting the Chair will ask that you state your name, spell your last name, and provide your neighborhood or place of residence for the record.  If you are providing testimony in a quasi-judicial matter, the Chair will confirm whether you are an "interested person" then your 3 minutes will begin. A few helpful hints when participating telephonically: use a land line and avoid speakerphone, if possible. Speak clearly and loudly. Ensure a quiet background environment. Wait to be called on by the Chair.

When signing up to testify telephonically, indicate in the subject line either public testimony, or a specific hearing item.

Public Comments: Citizen may speak on any matter not appearing on the agenda.

Quasi-judicial Hearing: Interested persons may speak on a particular request.  ​​​​​
